How do I know if my landlord is a large-scale landlord (“gran tenedor”)?
The first step is to look at the advert and the tenancy agreement. In Catalonia, the owner of a flat in a stressed residential market area (“zona tensionada”) who is a large-scale landlord must say so in both. Failing to do so is a serious infringement. If the landlord does not say so and you are unsure, ask in writing. The Catalan register of large-scale landlords is not open to public inspection, but there are signs that help, such as the owner being a company or owning a whole building.

José Manuel AlburquerqueWhy it matters to you
- In a stressed residential market area, if your landlord is a large-scale landlord, the rent under your tenancy cannot exceed the reference rent index of the “Ministerio de Vivienda”, Spain's Ministry of Housing. In Catalonia it is enough for the landlord to own five or more residential properties in the area.
- When the tenancy ends, if you prove that you are in a situation of vulnerability, the large-scale landlord must accept an extension of up to one year.
- If your landlord brings a possession claim against you, the claim must say whether the landlord is a large-scale landlord. It must also state whether the flat is your main home. In Catalonia, in addition, a large-scale landlord must make you an offer of social rent before suing you for non-payment if you are at risk of housing exclusion, although for this purpose Catalan law uses its own definition of large-scale landlord. If your tenancy agreement is dated 31 July 2026 or later, that definition covers, in principle, anyone who owns five or more homes anywhere in Catalonia.
How to find out
- Look at the advert. Since 8 October 2026, adverts for residential lettings throughout Spain have had to state that the owner is a large-scale landlord, if that is the case.
- Look at the tenancy agreement. In Catalonia it must record that status and the maximum rent, with the reference price document attached.
- Ask the landlord in writing, for example by email or by “burofax” (a certified letter with proof of content). The law says that large-scale landlord status is proved by a certificate from the “Registro de la Propiedad”, the Land Registry.
- Look at who the owner is. If it is a company, a fund, a bank or its property company, that is a sign, although not enough on its own. Owning a whole building is also a sign, because since 8 October 2026 all its homes count even if the building is not divided into separately registered flats.
The register of large-scale landlords (“Registre de persones grans tenidores d'habitatge”) is kept by the “Agència de l'Habitatge de Catalunya”, the Catalan housing agency. It provides its data to town councils and the courts, but it is not open to public inspection.
If the landlord has concealed it
- In Catalonia, failing to state it in the advert or the tenancy agreement is a serious infringement. You can report it to the public authorities.
- If the flat is in a stressed residential market area and the rent exceeds the index, the excess is void. You can claim back what you have overpaid, although before suing you will have to try to negotiate, as the law requires.
