How much can my rent go up this year?

If the anniversary of your residential tenancy falls between 8 October 2026 and 31 December 2027, the increase cannot exceed 2 % unless you agree to a different one. Even with your agreement, it cannot exceed the IRAV, the index that the “INE”, Spain's national statistics institute, publishes to cap these increases, which stood at 2,54 % in September 2026. If your rent is already above the maximum value that the state reference rent system gives for your home, it cannot be increased. Nor can it be increased if your tenancy agreement was signed from June 2013 onwards and does not provide for any update. In addition, the increase can only be charged from the month after you are notified of it in writing.

The rules today

For increases due between 8 October 2026 and 31 December 2027:

  • If the tenancy agreement was signed from June 2013 onwards and says nothing about updating the rent, there is no increase. In those signed between 1995 and June 2013, the rent is updated in line with the consumer price index (CPI) even if the agreement does not say so, subject to the same caps as other increases.
  • If your rent exceeds the maximum value that the state reference rent system gives for your flat, there is no increase either, even if the agreement refers to the CPI or the IRAV. This system, run by the “Ministerio de Vivienda”, Spain's Ministry of Housing, can be consulted online using the address or the cadastral reference of the property.
  • In all other cases, the increase is whatever the clause in the agreement provides, but no more than 2 %.
  • In those cases, you and the landlord can agree on a different increase, but never above the IRAV for the latest month published on the anniversary of the tenancy.

Increases that fell due before 8 October 2026 were made under the rule in force at the time and do not change.

An example

You pay 1.000 euros a month, your rent does not exceed the maximum value under the state system and your tenancy agreement, which provides for the rent to be updated in line with the IRAV, reaches its anniversary on 1 November 2026. On that day, the latest IRAV published is September's, at 2,54 %. Without a new agreement, the maximum increase is 2 %, so you will then pay 1.020 euros. Only if you agree could it rise to 2,54 %, that is, to 1.025,40 euros.

What to check

  • That the notice of the increase reaches you in writing and states the percentage. An increase that has not been notified to you in this way cannot be charged to you.
  • That it is applied on the anniversary of the tenancy. The rent is only updated once a year.
  • That your tenancy is a residential one. For commercial premises, offices and garages, whatever was agreed applies. If yours is a seasonal tenancy signed before 8 October 2026, different rules may apply.
