What is the maximum rent in a stressed residential market area (“zona tensionada”) in Catalonia?
It depends on the flat's history and on who is letting it. If it was let as a home in the last five years, the maximum is the last rent under that agreement, with its annual update. That rent can only be increased by up to 10 % in certain specific cases laid down by law, such as a recent refurbishment. If it was not let during that time, the maximum is the figure set for that home by the reference rent index of the “Ministerio de Vivienda”, Spain's Ministry of Housing. If the owner is a large-scale landlord (“gran tenedor”), which in Catalonia means anyone who owns five or more residential properties in the area, the rent can never exceed the index.

The limit goes with the home, not with the tenant. The maximum is the rent under the last residential tenancy in force during those five years, once the annual update it provided for has been applied. Since 8 October 2026 any residential tenancy counts, including a temporary tenancy or a tenancy by rooms. Previously only a main-home tenancy counted. Nor can fees or expenses be charged that the previous tenant did not pay.
That rent can only be increased by up to 10 % in these cases:
- A refurbishment of the home, within the meaning given to it by the rules on the “IRPF”, Spain's personal income tax, completed in the previous two years.
- An energy-efficiency improvement completed in the previous two years, with a saving of at least 30 % in non-renewable primary energy, certified by the energy performance certificates from before and after the works.
- An accessibility improvement completed within the same period and duly certified.
- A tenancy of ten years or more, or one giving the tenant the right to extend it to that length.
If it was not let or the owner is a large-scale landlord
If there was no residential tenancy at all in the previous five years, the maximum is the figure set for that home by the state system of reference rent indices, which can be consulted on the Ministry of Housing's website. This applies to any landlord, because the declarations of stressed residential market areas in Catalonia expressly provide for it. If the only tenancies during those years were seasonal ones signed before 8 October 2026, it is doubtful whether they count as a previous tenancy, so the prudent course is not to exceed the lower of the two limits, the last rent or the index.
If the owner is a large-scale landlord, the rent can never exceed the index, not even by charging separately for fees, general expenses, services, taxes or charges. If there was also a previous tenancy, the prudent course is to comply with the lower of the two limits as well. For the same reason, the 10 % for works should not take the rent above the index.
Other rules
- When letting by rooms, the total rent for all the rooms cannot exceed the maximum that would apply to the whole flat.
- If several temporary tenancies are signed one after another for the same flat, the rent under each one cannot rise by more than the IRAV, the index published by the “INE”, Spain's national statistics institute, that caps annual rent updates.
- The advert and the agreement must state the maximum rent. The document certifying the reference price must also be attached to the agreement.
For example, in a flat in Barcelona the last tenant was paying 1.100 euros a month, already updated, on leaving in 2025. If the owner is not a large-scale landlord, the new agreement cannot exceed 1.100 euros, or 1.210 if one of the works allowing the extra 10 % was carried out in the previous two years. If the flat had not been let since 2020, the maximum would be whatever the index gave for that home.
